POLICIES

WARRANTY COVERAGE:

(a) New Apple, & Apple Factory-Refurbished Products:
Warranty coverage is provided by any Apple Authorized Service Provider for the length of the Apple Warranty. Your GALAXYhp invoice provides the 'proof of purchase date' document that the Apple Authorized Service Provider will require to process any such Warranty claim.

(b) New 3rd Party Products:
Warranty coverage for new products is handled by GALAXYhp for the first 30 days following the invoice date, and by the manufacturer thereafter for the remainder of the warranty.

(c) LIFETIME MEMORY REPLACEMENT GUARANTEE:
RAM modules carry a lifetime warranty against electrical and manufacturing defect. Modules which fail will be replaced. Buyer is responsible for all associated shipping charges.

(d) Refurbished & Used Products:
Coverage is handled by GALAXYhp for the life of the item warranty.

(e) General Caveats:
Warranties are void and do not apply if a product has been modified, abused, subjected to static or electrical surges, or damaged due to improper installation. Decisions by the manufacturer, wholesaler or GALAXYhp with regard to the voiding of a warranty are final. GALAXYhp is not responsible for any damage or loss to equipment, property, person, program loss, or for costs associated with data recovery associated with use of any product sold by GALAXYhp. GALAXYhp is not responsible for installation charges. Installation should be performed by an authorized technician.Warranties are nontransferable. Buyer (not GALAXYhp) is responsible for all shipping costs associated with the repair/replacement of any item covered under warranty. GALAXYhp is not responsible for any data loss : Buyer is responsible for securing a back-up of all hard drive data prior to shipping parts to GALAXYhp.

Use the RMA Request Form before shipping product back to GALAXYhp for coverage under warranty.

ORDER FULFILLMENT

(a) All sales are final: Every product sold by GALAXYhp is covered under warranty, and any product which fails during its warranty period will be repaired or replaced. If we err and ship you an incorrect part it will be replaced by the correct one. If you order the wrong product it will be replaced with the correct one, providing the incorrect part remains sealed in its original packaging, and you accept a 20% restocking charge. Otherwise, and without exception, all sales are final.

(b) Accepted Payment Terms:
— International and US Money Order/Cashier's Check (in US dollars).
— Bank wire transfer in US dollars (there is a $35 bank wire transfer fee charged on wire transfers).
— PayPal.
— Major Credit Cards: Visa, MasterCard, Discover and American Express.
— Net terms available to U.S. schools and universities for orders accompanied by a Purchase Order.

(c) Sales Tax:
There is no sales tax in the State of Oregon.

(d) Pricing and Product Availability:
Pricing and product availability are subject to change without notice. You will receive an e-mail informing you if there is a pricing discrepancy, or if we are otherwise unable to fill your order.

(e) Exchange Purchase Option - 'Core' Returns:
To qualify for exchange, modules must be a genuine manufacturer part (of the same part #) in repairable condition. Parts with physical damage (broken boards, cracked LCD's, broken plastics, liquid spills or other un-repairable items) do not qualify for exchange. Parts returned with any physical damage, missing components or parts loaded with dead components will not be accepted, and the security deposit will be forfeit.

If you have any question as to the acceptability of your part, please contact your sales representative prior to placing an order. GALAXYhp reserves the right to reject any part for exchange. To take advantage of our Advanced Exchange Service you must pay for your order by credit card. A security deposit (fully-refundable) is charged to your card to ensure the prompt return of the defective part. The Advanced Exchange option is only available in the United States.

(f) Exchange Purchase Option - Security Deposit Refund:
It takes around 14 days from receipt of the 'core' return to process your refund. Your card is credited for amount of the original deposit, or a check is issued if you prepaid for your order or used PayPal.

(g) Shipping Methods and Charges:
To keep costs in check, and to expedite order fulfillment, many of the products we offer are shipped to you directly from the manufacturer or distributor. The chosen freight carrier is often at their discretion. We will always provide you with firm shipping costs when an order is placed, and provide you with the opportunity to change the shipment to a slower and, hence less expensive method.

US Orders:
Roughly speaking it can be assumed that a 3 lb package will cost around $12 for ground service, $20 for 3-day air, $28 for 2nd day air, and $38 for overnight delivery. If you prefer we can ship using your freight account number.

International orders:
Are generally shipped by US Global Airmail or by Regular Airmail. UPS and FedEx shipping options are available but are typically three times more expensive than the US Postal Service. There is a $10 handling fee for processing International orders. International shipping rates start at around $20 (US Global Express Mail). You will receive an e-mail confirming your order and including the shipping charge associated with it. GALAXYhp is not responsible, and cannot be held responsible, for any local customs duties or import taxes.

(h) Freight Damage Claims:
Shipments are insured against loss, theft or damage during shipping. If your shipment arrives damaged you must immediately contact GALAXYhp so that we can file a damage claim against the shipper and arrange for a replacement part to be shipped to you. Call GALAXYhp at 541-345-1817 to report receipt of a damaged shipment. Keep all packaging from the damaged shipment intact ready for inspection by the shipper's representative.

GENERAL

(a) Miscellaneous:
— Prices, product availability and policies are all subject to change without notice.

— It is the implied and express intention that any and all obligations arising from use of the abbreviations "GALAXYhp" and "WE" - in any context - are wholly and entirely assumed by "GALAXY Hardware Publishers Incorporated", a registered corporation in the State of Oregon.

— GALAXYhp is not an authorized Apple reseller.

— We are not responsible for any typographical, photographic, or technical/compatibility errors. If we err and ship you an incorrect part it will be replaced by the correct one.

— Title to items purchased is retained by GALAXYhp until payment for the items has been received in full. In the event of nonpayment, or payment default, you (as buyer) are responsible for all charges associated with the collection of monies owed to GALAXYhp.

— Products purchased from GALAXYhp may not be returned without a GALAXYhp-issued Return Merchandise Authorization (RMA) Number.

— All returned purchases are subject to a 20% restocking fee. BUYER is responsible for providing all required documentation associated with the export of any product purchased from GALAXYhp, and for fulfilling all obligations contained in such documentation.

(b) AGREEMENT of Limited Liability:

THE BUYER (you!) ACKNOWLEDGES AND AGREES THAT GALAXYhp SHALL NOT BE HELD LIABLE BY THE BUYER, OR BY ANY OTHER PERSON OR ENTITY, FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, EXPENSES, LOST PROFITS, LOST SAVINGS, OR OTHER LOSSES ARISING FROM THE USE OF ANY PRODUCT PURCHASED FROM GALAXYhp. IN ALL CASES, GALAXYhp'S LIABILITY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID FOR THE PRODUCT IN QUESTION FOR AN ITEM. SHIPPING AND HANDLING COSTS ARE NOT INCLUDED. THE BUYER ALSO AGREES THAT DISPUTES ARISING BETWEEN THE BUYER AND GALAXYhp WILL FALL UNDER THE JURISDICTION OF, AND BE VENUED IN THE STATE OF OREGON.

All products represented throughout the site have trademarks and copyrights which are the property of their corresponding owners. All trademarks, registered trademarks, servicemarks and copyrights are used to the benefit of, and without intent to infringe upon the mark holder.
